HumEnergi Privacy Notice

How HumEnergi collects, uses and protects the personal data you share through this website.

1. Who we are

HumEnergi Uganda Limited (“HumEnergi”, “we”) is responsible for the personal data you share through this website. We are registered with the Personal Data Protection Office (PDPO) of Uganda under registration number PDPO-202603-11497.

This notice explains what we collect through humenergi.com, why, who can see it, how long we keep it and your rights. It follows the Data Protection and Privacy Act, 2019 of Uganda.

2. What we collect

We only collect what you choose to send us through the two forms on this website:

• Contact form: your full name, email address, phone number (optional), the subject of your enquiry and your message.
• Loan application form: your organisation’s name and type, the contact person’s name, phone number and email address, your district or location, the type and amount of financing you need, and what you tell us about your business and your request.

The loan application may include financial information about your business. Uganda’s law treats financial information as special personal data. We only collect it with your explicit consent, which you give by ticking the box on the form, and only to assess your request.

We do not ask for other special data, such as health, religion, political opinions or sex life. Please do not include it in your message.

When you visit the site, our hosting provider also records basic technical data (your IP address, browser type and pages visited) to keep the site secure and working.

3. Why we use it, and on what basis

• To reply to your message or question. Basis: your consent.
• To assess whether your organisation is eligible for a HumEnergi loan, and to contact you about your application. Basis: your consent, and the steps you ask us to take before a possible loan agreement.
• To keep the records required by law and by our lending activity. Basis: legal obligations.
• To keep the website secure. Basis: your consent and our legitimate need to protect the site.

We do not use your data for any other purpose. We do not use it for advertising, and we never sell personal data, which is also prohibited by law.

Decisions on loan applications are taken by people at HumEnergi, not solely by a computer.

4. Do you have to give us this data?

No. Sending us your data is voluntary, and no law requires you to do it. However, the fields marked as required on each form are needed to deal with your request. If you do not provide them, we cannot reply to your message or assess your loan application.

5. Who can see your data

Only people who need it for the purposes above:

• HumEnergi staff, including staff provided by our shareholder Mercy Corps (Prosper Global): to reply to you and assess loan applications.
• HumEnergi’s Investment Committee and Board: only for loan applications that reach a decision stage.
• Elai Brands (Kampala): builds and maintains the website.
• Hostinger: hosts the website.
• Microsoft: provides our email system, where form messages arrive.
• Cloudflare: protects our forms against spam. It processes your IP address and basic browser data.

Our service providers may only use your data to provide their service to us, and must keep it confidential and secure. We may also share data when the law requires it, for example with a regulator or a court.

6. Storage outside Uganda

The website server is located in the Netherlands, in the European Union, where personal data is protected by the EU General Data Protection Regulation (GDPR). Our email system (Microsoft) stores messages on servers outside Uganda. Cloudflare may also process this technical data outside Uganda.

By ticking the consent box on the form, you agree to your data being stored outside Uganda for the purposes in section 3.

7. How long we keep it

• Contact form messages: 12 months after our last exchange with you.
• Loan applications that do not lead to a loan: 24 months after our decision. This allows you to ask us about the decision and the data we used.
• Loan applications that lead to a loan: for as long as the law and our lending records require.

After that, we delete the data in a way that it cannot be recovered, or we make it anonymous.

8. How we protect it

We limit access to the people listed in section 5, use password-protected accounts, use encrypted connections to the website (https) and keep regular backups. If we believe your data has been accessed by an unauthorised person, we will inform the Personal Data Protection Office immediately and follow its instructions, including informing you where required.

9. Your rights

You can ask us at any time to:

• confirm whether we hold personal data about you, describe it, and tell you who has had access to it. We will reply within 30 days. We will ask you for proof of identity before we reply;
• correct or delete data that is wrong, incomplete, out of date or that we no longer need. If we cannot do so, we will tell you why in writing;
• stop using your data, including by withdrawing your consent. This does not affect what we did before you withdrew it. Where this applies, we will reply in writing within 14 days;
• make sure that no decision about you is based only on automated processing.

If you are not satisfied with our answer, you can complain to the Personal Data Protection Office of Uganda (pdpo.go.ug).

10. Children

This website and our loans are for organisations and adults. We do not knowingly collect data from anyone under 18.

11. Cookies

The website only uses technical cookies that it needs to work and stay secure. We do not use analytics, advertising or tracking cookies.

12. Changes and contact

We may update this notice. The date below shows the latest version.
